1. Introduction

Welcome to Shifupay. These Terms and Conditions ("Terms") govern your use of the Shifupay platform, including our website and mobile application (collectively, the "Service"), operated by Shifupay ("we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement. Users must comply with all applicable laws and regulations in Malawi and their respective jurisdictions.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information to keep it accurate and complete.
  • Maintain the security and confidentiality of your login credentials.
  • Accept responsibility for all activities that occur under your account.
  • Notify us immediately of any unauthorized use of your account.

4. Services Provided

Shifupay provides the following services:

  • Cryptocurrency Exchange: Facilitating the buying, selling, and exchange of cryptocurrencies using Malawian Kwacha (MWK).
  • Deriv Transactions: Deposits, withdrawals, and international transfers related to Deriv trading accounts.
  • E-Wallet Services: Digital wallet transfers and management.
  • Forex Education: Educational content and lessons on forex trading.
  • Trading Signals: Subscription-based trading signals and market analysis.

5. Transaction Terms

All transactions are subject to the following conditions:

  • Exchange rates are determined at the time of transaction and may fluctuate.
  • Transaction fees are displayed before confirmation and vary by service type.
  • Minimum and maximum transaction limits apply and are displayed on the platform.
  • Transactions are processed in the order they are received and may take time to complete.
  • We reserve the right to reject, delay, or cancel transactions that violate these Terms or applicable laws.
  • Proof of payment may be required for certain transaction types.

6. KYC and Verification

To comply with anti-money laundering (AML) regulations, we may require you to complete identity verification (Know Your Customer or KYC). This may include providing government-issued identification, proof of address, and other documentation. Failure to complete verification may result in restricted access to certain features or account suspension.

7. Prohibited Activities

You agree not to:

  • Use the Service for any illegal, fraudulent, or unauthorized purpose.
  • Attempt to gain unauthorized access to other user accounts or our systems.
  • Use the Service for money laundering, terrorist financing, or other financial crimes.
  • Manipulate or interfere with the proper functioning of the Service.
  • Create multiple accounts for fraudulent purposes.
  • Provide false or misleading information.
  • Reverse-engineer, decompile, or disassemble any part of the Service.

8. Fees and Charges

Shifupay charges fees for certain services, including but not limited to transaction fees, exchange spreads, and subscription fees. All applicable fees are displayed transparently before you confirm a transaction. We reserve the right to modify our fee structure with prior notice to users.

9. Risk Disclaimer

Cryptocurrency and forex trading involve significant risk of financial loss. Prices are highly volatile and can change rapidly. You acknowledge that:

  • Trading signals and educational content do not guarantee profits.
  • Past performance is not indicative of future results.
  • You are solely responsible for your trading decisions.
  • You should never invest more than you can afford to lose.

10. Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time if we reasonably believe that you have violated these Terms, engaged in fraudulent activity, or if required by law. Upon termination, any pending transactions may be cancelled, and your access to the Service will be revoked.

11. Account Deletion

You may request to delete your account at any time. To delete your account:

  1. Via the App or Website: Go to Settings > Profile > Delete Account and follow the on-screen instructions.
  2. Via Email: Send a request to sales@shifupay.net from the email address associated with your account, with the subject line "Account Deletion Request".

Please note that all pending transactions must be completed or cancelled before your account can be deleted. Account deletion is permanent and cannot be undone. Certain data may be retained as required by law or for legitimate business purposes, as outlined in our Privacy Policy.

12. Intellectual Property

All content on the Service, including text, graphics, logos, and software, is the property of Shifupay or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from any content without our prior written consent.

13. Limitation of Liability

To the fullest extent permitted by law, Shifupay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount of fees paid by you in the twelve (12) months preceding the claim.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Service. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify users of significant changes via email or in-app notifications.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Malawi. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Malawi.
